The hours after a Kentucky crash shape your whole claim. Follow this step-by-step checklist to protect your health, your evidence, and your right to compensation.
1. Safety and 911 first
If anyone is hurt, call 911 immediately. On Kentucky interstates and rural highways, getting a police response and an official crash report is important both for safety and for your claim. If vehicles can be moved safely out of traffic, do so; otherwise turn on hazards and stay clear of the roadway.
2. Get medical care — even if you 'feel fine'
Adrenaline masks injuries. Whiplash, concussions, and internal injuries often don't hurt until hours or days later. Seeing a doctor promptly protects your health and creates the medical record that supports your claim. A gap in treatment is one of the first things insurers use to argue you weren't really hurt.
3. Document everything at the scene
If you can safely do so, photograph all vehicles, damage, the overall scene, traffic signs and signals, skid marks, and road conditions. Get the other driver's name, license, insurance, and plate, and collect names and numbers of any witnesses. Note the time, weather, and exactly how it happened while it is fresh.
4. Be careful what you say
Do not apologize or admit fault at the scene — even politeness can be twisted later. Stick to exchanging information and cooperating with police. Decline to give the other insurer a recorded statement until you've spoken with an attorney.
5. Notify your insurer and start your PIP claim
Report the crash to your own insurer to open your Personal Injury Protection (PIP) benefits, which pay initial medical bills and lost wages regardless of fault. Keep copies of everything.
6. Talk to a lawyer before you settle
Before accepting any offer or signing anything, get a free case review. Once you sign a release you cannot reopen the claim.
